Website terms, booking terms, and appointment consent
These Terms apply when you access elegantlashesbykatie.com, use our website, select a booking option, book an appointment through our website or an approved booking platform, visit a salon location, or receive services.
By selecting a booking option, scheduling an appointment, visiting any salon location, signing an electronic or paper consent form, or receiving services, you agree to these Terms of Service, our Privacy Policy, our Cancellation Policy, our Refund Policy, our 3-Day Fix Policy, and other posted salon policies that apply to your appointment.
Before service begins, you may also be asked to review and sign or electronically accept an appointment-specific client consent, waiver, release, arbitration agreement, media authorization, or similar form. We maintain version, signature, timestamp, and related audit records for our files, but those internal identifiers do not need to appear in this public notice.
This page is intended to give website visitors and booking clients clear notice of the terms that may apply before, during, and after service. If these posted Terms and a signed or electronically accepted appointment-specific form address the same subject, both apply to the fullest extent allowed by law. If there is a direct conflict, the signed appointment-specific form controls for that appointment unless applicable law requires otherwise.
1. Services and Visit Scope
Elegant Lashes by Katie provides lash, brow, waxing, facial, esthetic, cosmetic, retail, consultation, removal, touch-up, aftercare, and related beauty services at our Orange County locations, including Irvine, Tustin, Santa Ana, Costa Mesa, and Newport Beach.
These Terms cover everything reasonably connected to your visit, including booking, check-in, waiting, seating, preparation, cleansing, lash baths, application, fills, touch-ups, removal, patch testing, product use, retail or product interactions, aftercare guidance, restroom use, and entering, leaving, or moving through the salon.
Products may include adhesives, removers, cleansers, tints, waxes, tapes, pads, patches, solutions, skincare, aftercare, retail products, tools, devices, instruments, and other materials used or offered. We may modify, pause, decline, reschedule, cancel, or discontinue any service when needed for scheduling, safety, sanitation, product, skin, eye, health, allergy, medication, comfort, behavior, legal, staff availability, or business reasons.
2. Appointment Booking, Cancellations, and Late Arrivals
Booking
Appointments can be made through our website, by phone at 657-334-9919, through approved booking platforms, or in person at a salon location. All appointments are subject to availability, location rules, technician availability, and booking-platform terms.
Cancellation Policy
- Our posted Cancellation Policy controls cancellation, late-cancellation, no-show, rescheduling, fee authorization, and fee-dispute terms.
- Cancellations made more than six hours before the scheduled appointment time are free under the Cancellation Policy.
- Cancellations made six hours or less before the scheduled appointment time and no-shows are subject to a $25.00 fee unless applicable law or management-approved written exception requires otherwise.
- A no-show includes failing to arrive within 15 minutes after the scheduled appointment time without prior cancellation, or arriving too late for us to reasonably provide the scheduled service without disrupting later appointments.
- Repeated late cancellations, no-shows, repeated rescheduling, or failure to follow booking instructions may result in required deposits, prepayment requirements, account restrictions, or refusal of future booking.
- Promotions, deposits, packages, memberships, and third-party booking offers may have additional disclosed terms.
Late Arrivals
If you arrive late, your appointment may be shortened, modified, or rescheduled so we can avoid delays for other clients. A shortened appointment does not guarantee the same result as the full scheduled service.
3. Payment Terms, Final Sales, and Refunds
- Payment is due at the time of service unless another payment arrangement is approved in advance.
- We may accept cash, credit cards, debit cards, gift cards, booking-platform payments, or other payment methods we choose to accept.
- Prices, menus, promotions, and service availability may change without prior notice, except where notice is required by law.
- Gift cards and gift certificates are handled according to applicable California gift certificate law and any terms disclosed at purchase, including cash redemption of qualifying low balances and limits on expiration dates or service fees where required.
- Tips and gratuities are optional, voluntary appreciation for service. Once given, tips are final and are not refundable, credited, or applied toward future service except as required by law.
- All service sales are final and non-refundable once service is completed and you leave the salon, except as required by law or written business policy and subject to our posted Refund Policy and 3-Day Fix Policy.
If we choose to offer a courtesy refund, credit, re-service, adjustment, complimentary removal, or other accommodation, that choice is a business decision unless otherwise required by law and does not create a future obligation.
4. Beauty Service Risks
Beauty services may involve adhesives, removers, cleansers, tints, waxes, chemicals, tools, devices, sharp instruments, tape, pads, patches, solutions, lights, heat, and other products or materials used near the eyes, skin, hair, face, or body.
You understand and accept that risks may occur even when reasonable care is used. Risks include, but are not limited to, chemical exposure, burns, corneal abrasions, temporary or permanent eye injury, eye irritation, inflammation, redness, swelling, watering, dryness, allergic or sensitivity reactions, infection, discomfort, pain, changes in skin color, dissatisfaction with appearance, uneven or incomplete results, lash or hair shedding or loss, skin lifting, bruising, scarring, and effects from prior or future products, services, procedures, medications, health conditions, or home care.
Salon staff are not doctors, pharmacists, or medical professionals. We do not diagnose medical conditions or decide whether a service is medically appropriate for you. If you have questions about your personal risk, consult a licensed medical professional before booking or receiving service.
5. Client Health Information and Safety Responsibilities
Before service begins, and before service continues if anything changes, you are responsible for telling your technician or salon staff about any allergies, sensitivities, medical conditions, medications, skin or eye conditions, recent cosmetic, esthetic, dermatologic, medical, spa, or home treatments, prior adverse reactions, pregnancy, recent procedures, product use, or other concern that could affect your service, comfort, safety, healing, or results.
Movement, distraction, phone use, talking, sneezing, or failure to follow instructions during service can increase the chance of injury or a poor result. During services near the eyes or face, you agree to keep your eyes fully closed until told otherwise, remain as still as reasonably possible, limit phone use and other distractions, limit talking when instructed, and follow all verbal and written instructions from technicians and salon staff.
If an injury, irritation, complication, or poor result is caused in whole or in part by movement, distraction, talking, failure to disclose relevant information, or failure to follow instructions, that remains your responsibility to the fullest extent allowed by law. We may pause, modify, decline, stop, or reschedule service if a disclosed or observed condition creates a safety, sanitation, product, skin, eye, health, allergy, medication, comfort, behavior, or legal concern.
6. Aftercare, Maintenance, and Outside Products
You are responsible for following aftercare instructions provided by our team. Improper aftercare, picking, pulling, rubbing, sleeping habits, makeup, oil, water, steam, incompatible products, self-removal attempts, outside salon work, or home treatments may affect comfort, safety, lash retention, and results.
We are not responsible for damage, irritation, retention issues, service changes, or appearance concerns caused by aftercare issues, outside products, outside services, undisclosed conditions, or client conduct.
7. Results, Style Approval, and Fix Requests
No specific result, appearance, fullness, style match, longevity, retention period, comfort level, reaction, healing, compatibility, or outcome is guaranteed. Results vary based on health, anatomy, natural lashes, skin chemistry, eye shape, lash or hair condition, medications, prior services, service selected, professional safety limits, lifestyle, aftercare, home products, and other factors.
Reference photos, menu photos, social media photos, and salon example photos are for inspiration and illustration only. We do not promise an exact match to any photo or prior service.
Qualifying visible application concerns may be reviewed under our 3-Day Fix Policy. That policy provides a courtesy review process only and does not create a refund right except as required by law.
8. Security Cameras and Recording
Our salon operates as a visibly recorded salon environment in permitted areas. Our lash service areas are generally open-concept spaces, including reception areas, lash bar areas, open studios, treatment areas, and service rooms or spaces separated by curtains or doors. In those areas, conversations may be overheard by staff or other clients and should not be treated as private or confidential.
The salon may use visible audio and video cameras or similar monitoring in permitted reception, retail, open studio, treatment, service, one-on-one service, or common areas after front-area signage or posted notice, check-in notice or waiver presentation, appointment consent, or other legally required notice or consent is provided. Monitoring may be used for safety, security, operations, quality assurance, training, service documentation, dispute handling, insurance, liability defense, and other legitimate business purposes, to the extent allowed by law.
No hidden audio or video recording is authorized by these Terms or by any appointment waiver. Audio or video recording does not apply to restrooms, changing areas, undressing areas, waxing or body-service areas where clothing is removed, or any other area where recording would be prohibited by law or where a person would reasonably expect complete privacy for undressing or similar private activity, unless separate specific consent is obtained and the recording is allowed by law.
Staff or technician consent, internal policy, and posted notices are handled separately from client consent. Clients may not take photos, audio recordings, or video recordings in the salon unless salon management clearly allows it. If you do not agree to receive service in a recorded salon environment, do not proceed with service.
9. Photography, Digital Editing, AI-Assisted Media, and Commercial Use
We may ask to photograph, film, record, or document service results. Identifiable client media used for advertising, marketing, website, portfolio, social media, or other commercial business purposes will be used only with client consent, a signed or electronically accepted media authorization, or another legal basis allowed by law.
Media permission may include a continuing, royalty-free, worldwide, transferable, and sublicensable consent and license to photograph, film, record, reproduce, publish, display, distribute, edit, create derivative works from, and otherwise use media of you for service documentation, education, training, advertising, marketing, website, portfolio, social media, internal business, and other commercial business purposes, without additional notice, approval, inspection, or compensation, to the maximum extent allowed by law.
Media permission may also include the right to retouch, crop, resize, color-correct, adjust lighting, remove or change backgrounds, apply filters, edit, enhance, stylize, composite, use generative fill, use AI-assisted editing tools, create derivative marketing materials, and otherwise digitally alter or AI-assist media. Edited or AI-assisted images or videos may not be a literal documentary depiction of the original photo, video, setting, lighting, background, or appearance.
We do not intend to use client media in a humiliating, sexually explicit, discriminatory, defamatory, unlawful, false-endorsement, or intentionally offensive manner, and we do not knowingly use edited or AI-assisted media to make materially false or misleading claims about service results. If you believe a media use was misunderstood, used in error, or used in a way that concerns you, notify us in writing and give us a reasonable opportunity to review, explain, revise, remove, or otherwise address the concern before starting a formal claim, to the extent allowed by law.
10. Private Communications and Business Records
Communications with the business, owner, employees, contractors, technicians, managers, agents, or representatives may include private or confidential information. Except as allowed by law or with our written permission, you agree not to publicly post, upload, distribute, or submit screenshots, recordings, transcripts, copies, or substantially complete reproductions of private business communications or records.
This includes text messages, direct messages, emails, voicemail or phone recordings, appointment notes, internal records, staff contact information, private phone numbers, or similar private communications. This section does not stop you from making lawful reports to government agencies, responding to subpoenas or court orders, communicating with your own legal or medical advisors, or sharing a truthful summary of your own experience in a review or other lawful statement.
11. Reviews, Public Statements, Photos, and Online Conduct
You may post honest reviews and truthful opinions about your own experience. You agree not to knowingly or recklessly post, submit, encourage, or spread false statements, misleading edits, fake reviews, spam, threats, harassment, abusive or discriminatory content, private or confidential information, images or identifying information of staff or other clients without consent, or manipulated, staged, incomplete, or bad-faith photos, videos, screenshots, or recordings that create a false or misleading impression.
If we have a legitimate basis to believe public content is false, misleading, harassing, unlawful, spam, or includes private or confidential information, we may request correction or removal, report the content to the platform, preserve evidence, and pursue available legal remedies to the extent allowed by law. Nothing in these Terms prevents you from posting an honest review, opinion, photo, or other lawful statement about your own experience.
12. Respectful and Safe Conduct
You agree to treat salon staff, technicians, contractors, managers, representatives, clients, and guests with respect. We may decline, pause, stop, reschedule, cancel, or refuse service if conduct is rude, threatening, harassing, discriminatory, unsafe, disruptive, disrespectful, recording-related, privacy-violating, intoxicated, impaired, or rule-breaking, or if conduct interferes with service quality, safety, privacy, or normal salon operations.
We may also refuse service if a disclosed or observed condition creates a safety, sanitation, product, skin, eye, health, allergy, medication, comfort, or legal concern.
13. Age Requirements
Clients must be at least 18 years old to receive services unless a parent or legal guardian accompanies the minor, provides any required consent, and remains available as required by salon policy and applicable law.
14. Website Use and Intellectual Property
All content on this website, including text, graphics, logos, images, videos, service menus, layout, and software, is owned by or licensed to Elegant Lashes by Katie and is protected by copyright, trademark, and other laws. You may not copy, scrape, reproduce, distribute, frame, modify, or create derivative works from our content without written permission.
You agree not to:
- Use our website for any unlawful, misleading, fraudulent, abusive, or harmful purpose.
- Attempt to gain unauthorized access to our website, analytics, booking systems, accounts, or business systems.
- Transmit viruses, malware, harmful code, spam, automated scraping requests, or disruptive traffic.
- Impersonate any person or entity or misrepresent your relationship with us.
- Harvest, scrape, or collect user, staff, client, pricing, content, or business information except as allowed by law.
15. Third-Party Links and Booking Platforms
Our website may link to third-party websites, maps, payment processors, social media platforms, review platforms, booking platforms, and other services. We are not responsible for third-party content, availability, security, privacy practices, terms, fees, errors, or outages.
16. Release, Claims, and Limitation of Liability
To the fullest extent allowed by law, you release Elegant Lashes by Katie, its owner, employees, independent contractors, technicians, managers, agents, representatives, affiliates, and service providers from claims, demands, actions, damages, losses, liabilities, costs, expenses, or causes of action arising from or relating to services, your visit, products, recording or media use, any signed or electronically accepted appointment agreement, a claimed injury or loss, or your presence on, entry to, exit from, movement through, or use of the premises, including service areas, treatment rooms, waiting areas, seating, walkways, reception, retail or product areas, floors, wet or slippery areas, mats, cords, thresholds, steps, doors, furniture, chairs, beds, stools, carts, retail displays, product displays, tools, equipment, and restrooms, when those claims are based on ordinary negligence, premises liability, or risks described in these Terms or an appointment-specific agreement.
This release does not apply to gross negligence, reckless conduct, willful misconduct, willful injury, fraud, violation of law whether willful or negligent, unauthorized media use, hidden recording, or any claim that California law does not allow to be released.
17. Indemnification
To the fullest extent allowed by law, you agree to indemnify and hold harmless Elegant Lashes by Katie, its owner, employees, contractors, agents, affiliates, managers, representatives, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your violation of these Terms, misuse of our website, unsafe conduct, unlawful conduct, privacy-violating conduct, false or misleading statements, or failure to follow salon instructions.
18. Binding Arbitration, Jury Waiver, and Governing Law
These Terms are governed by California law. To the fullest extent allowed by law, covered disputes brought by you and arising out of or relating to services, your visit, premises, products, payment, refunds, communications, these Terms, a signed or electronically accepted appointment agreement, a claimed injury or loss, recording or media use, photography, digital editing, AI-assisted media, commercial media use, private communications, business records, or public statements will be decided by binding arbitration in California before a neutral arbitrator under then-applicable consumer arbitration rules of JAMS or the American Arbitration Association, instead of by a court or jury.
The business will pay arbitration forum costs to the extent required by applicable law, arbitration provider rules, or an appointment-specific agreement. Government reports, emergency injunctive relief where legally available, and rights or remedies that cannot legally be waived remain available.
If the arbitration provision cannot be enforced for a particular claim or party, then that claim or dispute will be handled in a state or federal court in Orange County, California, to the extent allowed by law.
19. Unknown Claims Under California Law
California Civil Code Section 1542 generally protects unknown claims from a general release. Some signed or electronically accepted client releases may include an express Civil Code Section 1542 waiver. Any waiver of those protections applies only to the extent stated in the signed or electronically accepted release and allowed by law.
20. Electronic Records and Signatures
You may be asked to conduct appointment paperwork electronically. To the extent allowed by law, you agree that an electronic record or electronic signature may not be denied legal effect solely because it is electronic, that your signature and signing actions may be attributed to you based on the context and signing evidence, and that we may retain electronic records of consent, waiver, release, arbitration, media, payment, service, and appointment documents for later reference.
21. Severability and Survival
If any part of these Terms is found invalid, void, unfair, or unenforceable, that part will be limited or removed only as much as needed, and the rest of these Terms will remain in effect to the fullest extent allowed by law.
Any part of these Terms that is meant to continue after a website visit, booking, appointment, service, payment, cancellation, media use, or dispute will continue.
22. Changes to Terms
We may modify these Terms and posted salon policies at any time without prior notice, except where notice is required by law. Changes are effective when posted to our website. Your continued use of our website, booking systems, locations, or services after changes are posted means you accept the updated terms to the fullest extent allowed by law.
